الإعراب في النحو العربي وأثره في ترجيح الخطاب الشرعي

Abstract

تهدف هذه الدراسة إلى النظر في ظاهرة الإعراب وكيفية استثماره من قبل النّحاة والأصوليّين بوصفه أداة من أدوات الإفصاح عن مضمون الخطاب الشرعي ومقصد الشارع عزّ وجل، وقد اعتمدنا المنهج الوصفي، حيث أثمرت الدراسة عن جملة من النتائج أهمها: الإعراب مرجِّح يعمد إليه علماء العربية من أجل درء الخلاف عند وقوع التعارض بينهم، كما يعتمدون عليه عند توجيه المسائل النحوية والفقهية. فتتجسد بذلك أهمية النتائج المتوصل إليها في كون الإعراب من علوم الآلة الخادمة للنص الشرعي، إذ استثمرها العلماء عند بيان وتوضيح الأحكام الفقهية. Abstract: This study aims to examine the phenomenon of parsing and how it is invested by grammarians and fundamentalists as a tool for disclosing the content of the legal discourse and the purpose of the Almighty Law-giver. We have adopted the descriptive approach, as the study yielded a number of results, the most important of which are: the syntax is preferred by Arab scholars in order to stave off disagreement when there is a conflict between them, as they rely on it when directing grammatical and jurisprudential issues. Thus, the importance of the results reached is embodied in the fact that parsing is one of the sciences that serve the legal text, as scholars invested it when explaining and clarifying jurisprudential rulings.
