النظام القانوني للمحكمة الدستورية

Abstract

من خلال هذه الدراسة تمكنا من معرفة أن التعديل الدستوري لسنة2020 قد مس جوانب كثيرة بخصوص الأحكام المتعلقة بالمحكمة الدستورية, والمحكمة الدستورية فتحت المجال لأهل الاختصاص في القانون وتوسيع اختصاصات وصلاحيات المحكمة الدستورية إضافة على مهامها السابقة من رقابة مطابقة ورقابة دستورية والنظر بعدم الدستورية واعتبرا استحداث المحكمة الدستورية يرتبط بتوسيع مجالات الرقابة على دستورية القوانين, سيما بعد الاتساع المتزايد للحقوق والحريات الأساسية في المنظومة القانونية وتكييفها مع الآليات والاتفاقيات الدولية, باعتماد مقاربة منهجية أملاها الواقع الوطني الراهن. وانتقل المؤسس الدستوري الجزائري بموجب التعديل الدستوري لسنة 2020 بالرقابة على دستورية القوانين إلى الأسلوب الملائم بما يضمن للرقابة فعاليتها والحفاظ على جوهر مهامها فا تم احتيار الأخذ بالرقابة بواسطة جهة قضائية متمثلة في المحكمة الدستورية وكلفها دون غيرها بضمان احترام الدستور ونشاط السلطات العمومية, مستعينا بذلك عن أسلوب الرقابة السياسية على دستورية القوانين بواسطة المجلس الدستوري الذي تعلق به تاريخ الرقابة على دستورية القوانين في الجزائر منذ أول دستور لها. Through this study, we were able to know that the constitutional amendment for the year 2020 touched many aspects regarding the provisions related to the Constitutional Court, and the Constitutional Court opened the way for those with jurisdiction in law and expanded the powers and powers of the Constitutional Court in addition to its previous tasks of conformity and constitutional oversight and consideration of unconstitutionality and considered the creation of the Constitutional Court It is linked to the expansion of the areas of control over the constitutionality of laws, especially after the increasing expansion of basic rights and freedoms in the legal system and their adaptation to international mechanisms and agreements, by adopting a systematic approach dictated by the current national reality. The Algerian constitutional founder, according to the constitutional amendment of 2020, moved to monitor the constitutionality of laws to the appropriate method to ensure its effectiveness and preserve the essence of its tasks. Political oversight on the constitutionality of laws by the Constitutional Council, to which the history of oversight over the constitutionality of laws in Algeria has been attached since its first constitution.
