تكريس مبدأ الرقابة على دستورية القوانين واستحداث المحكمة الدستورية في الجزائر

Abstract

تعدالمحكمة الدستورية مؤسسة ذات طابع قضائي جاءت كبديل للمجلس الدستوري الذي تختلف عنه في التشكيلة والصلاحيات، ومن صلاحياتها التي خولها له القانون الرقابة على دستورية القوانين والفصل في المنازعات الانتخابية والاختصاص الاستشاري والتقريري، وصلاحيات استحدثها التعديل الدستوري لسنة 2020 والمتمثل في ضبط سير المؤسسات الدستورية من خلال فض النزاعات بين المؤسسات، كما لها دور في تكريس دولة الحق والقانون. وعلى الرغم من أن رقابة هذه المحكمة هي رقابة قضائية إلا أننا نلاحظأن المؤسس الدستوري الجزائري لم يفصل في طبيعتهالأنها احتفظت ببعض سيمات المجلس الدستوري من حيث العضوية وجهات الإخطار.:The Constitutional Court is an institution of a judicial nature that came as an alternative to the Constitutional Council, which differs from it in its composition and powers. Among its powers granted to it by law is to monitor the constitutionality of laws, adjudicate electoral disputes, advisory and reporting jurisdiction, and powers introduced by the constitutional amendment of 2020, which is to control the functioning of constitutional institutions through Settling disputes between institutions, as well as having a role in establishing the rule of law and law. Although the oversight of this court is judicial, we note that the Algerian constitutional founder did not decide on the nature because it retained some of the features of the Constitutional Council in terms of membership and notification bodies.
