Abstract

في ظل العجز الذي عرفته المرافق العامة بسبب الأوضاع الاقتصادية المتدهورة وانعكاسات هذا العجز على الدولة ومؤسساتها وعلاقتها بالمواطن، ما دفع الدولة إلى إعادة النظر في أهمية إشراك القطاع الخاص في التسيير المرافق العمومية، مع تزامن مع توجه الدول نحو سياسة الاقتصاد الحر وحرية المنافسة، وتحرير القطاع الاقتصادي من الاحتكار، حيث أصبح من الضروري التفتح على العالم الخارجي واعتماد أساليب جديدة كعقد الامتياز لتسيير المرافق العمومية. In light of the deficit that the public utilities have known due to the deteriorating economic conditions and the repercussions of this deficit on the state, its institutions and its relationship with the citizen, which prompted the state to reconsider the importance of involving the private sector in the management of public utilities, which coincided with the states orientation towards a policy of free economy and freedom of competition, and the liberalization of the sector From the economic monopoly, it became necessary to open up to the outside world and adopt new methods such as the concession contract to run public utilities.
