Abstract

تناول هذا البحث مضار الناجمة على الجوار وتطبيقاتها الحديثة فقد عرجت على المفاهيم الخاصة بالجوار والملكية على المستويين القانوني المدني والإسلامي، ثم تطرقت للحديث على التطبيقات الحديثة بختيار مجموعة من الأج ا زء وتسليط الضوء عليها لمعرفة أض ا ررها على المجتمع، وعند لحديث على المضار لابد من الوقوف عند العوض أو المقابل أو العقوبة فكانت العقوبات في نوعين العيني والمادي لتوضيح أن لكل فعل غير ملائم يتحمل صاحبها المسؤولية أمام القانون بعقوبة يستحدثها القانون في كل أنحاء العالم.This research dealt with the harms caused by neighborhood and its modern applications. I got acquainted with the concepts of neighborhood and property at the civil and Islamic legal levels, and then touched upon the modern applications by choosing a set of parts and highlighting them to find out their harms to society. when talking about the harm, it is necessary to stand at compensation, compensation or punishment. the penalties were of two types, in kind and material, to clarify that for each inappropriate act, the owner bears responsibility before the law with a penalty created by the law all over the world .
