Abstract

انتشرت في السنوات الأخيرة ظاهرة خصخصة الحرب كإستراتيجية أمنية جديدة، إذ أصبحت الدول تستعين خلال النزاعات المسلحة بالشركات العسكرية والأمنية الخاصة التي تؤدي وظائف كانت في السابق حكرا على القوات المسلحة النظامية، فقد أضحت هذه الشركات سمة من سمات النظام الدولي الجديد وأخذت تتصرف في الأمن وكأنه سلعة تباع بعيداً عن كل القيم والمبادئ الأخلاقية التي تحكم العلاقات الدولية، من هذا المنطلق سنبحث فيما يلي في وضع الشركات العسكرية الدولية الخاصة ومدى التزام قواتها بتطبيق قواعد القانون الدولي الإنساني وإمكانية مساءلة قواتها عن الانتهاكات الجسيمة لقواعده أثناء النزاعات المسلحة. In recent years, the phenomenon of privatization of war has become a new security strategy. During armed conflicts, States have used private military and security companies that perform functions previously reserved for the regular armed forces. These companies have become a feature of the new international order and are acting in security as a commodity. They are sold far from all the ethical values and principles that govern international relations.
