Abstract

ملخص: تعتبر الجاسوسية التقليدية من بين المشاكل التي لا يزال المجتمع الدولي لم يضع لها اتفاقية أو يحدد لها نص عام حول طبيعتها القانونية وطريقة استخدامها، وما زاد الأمر تعقيدا هو تطور وسائل ومعدات هذه الأعمال بسبب التطور التكنولوجي والعلمي، فأصبحت الدول تستخدم فضاءات ومجالات لم تكن تستعمل سابقا وهي الهواء الذي يعلو إقليم الدول. هذا ما فرض على الدول التفكير في وضع تنظيم قانوني دولي للاستخدام السلمي للهواء عن طريق تقنين معاهدات دولية لتنظيم الملاحة في هذا المجال، وتعزيز قاعدة أن سيادة الدولة هي الأساس هناك وذلك بهدف تجنيب الدول مخاطر أعمال الجاسوسية عليها.
