آليات تحقيق الأمن القانوني في مجال الملكية العقارية الخاصة

Abstract

الأمن القانوني هو مجموع المبادئ والأسس التي وجدت مع وجود التقنين، ولأهميته تمت دسترته ليدرج شئيا فشيئا في القواعد القانونية المنظمة لمختلف المجالات، وارتباط تحقيق الأمن القانوني بمجال الملكية العقارية عموما والملكية الخاصة على وجه التحديد، تبنى المشرع الجزائري نظام الشهر العيني الذي يقوم على أساس المسح العام للعقارات، ومن آثاره الدفتر العقاري الذي رغم حجيته النسبية الاَّ أنه يعد سند اثبات الملكيات، خاصة في مجال المعاملات العقارية وذلك بضمان حقوق المتعاملين في ظل نظام التوثيق مما يحقق الأمن القانوني للأطراف والغير، و أخضع المشرع الجزائري الافراد لضوابط تنظم مجال العمراني باعتباره أحد مقومات التطور والحضارة. كما يسعى المشرع الى حماية المالك الظاهر، حيث أفرد له حماية في نصوص القانون المدني وضح فيها العناصر والشروط التي يجب أن تتوفر لتحقق هذه الحماية، ليتكامل هذا التكريس بشهادة الحيازة في إطار مبادئ الأمن القضائي والأمن القانوني. كذلك أفرد المشرع الجزائري وسائل لإثبات ملكية المالك الظاهر قانونا وبعد مرور مدة معينة من الزمن من خلال آلية التقادم المكسب أوعن طريق التحقيق العقاري بموجب القانون 07/02، حيث يسمح للأفراد من تقرير حقوقهم في ملكياتهم المحازة وهذا إعمالا لمبدأ التوقع المشروع الذي يكفل الأمن القانوني والشرعية ويزرع الثقة والائتمان لأصحابها. Abstract : Legal security is the sum of the principles and foundations that existed with the existence of legalization, and because of its importance, it was managed to be included little by little in the legal rules governing various fields, and the connection of achieving legal security with the field of real property in general and private property in particular, the Algerian legislator adopted the system of the month in kind, which is based on the general survey of real estate, and one of its effects is the real estate ledger, which, despite its relative authority, is a proof of ownership, especially in the field of real estate transactions, by guaranteeing the rights of dealers under the notarization system, thereby achieving legal security for parties and others, and the Algerian legislator has individuals to regulate the urban field as one of the components Evolution and civilization. The legislator also seeks to protect the apparent owner, as he has assigned protection to him in the texts of the civil code, in which he clarified the elements and conditions that must be met to achieve this protection, so that this dedication is integrated with the certificate of possession within the framework of the principles of judicial security and legal security. The Algerian Legislature has also allocated means to prove the ownership of the apparent owner legally and after a certain period of time through the mechanism of earned limitation or through real estate investigation under law 07/02, where individuals are allowed to determine their rights to their acquired property and this is in implementation of the principle of legitimate expectation that ensures legal security and legitimacy and cultivates trust and credit to the owners..
