آليات حماية الأملاك العقارية الوقفية في التشريع الجزائري

Abstract

وضع المشرع الجزائري عدة آليات قانونية، من شأنها إيجاد دعامة قوية تهدف لحماية الأملاك العقارية الوقفية، وتتمثل هذه الحماية في أجهزة إدارية تسهر على حماية الوقف من الاعتداءات، كما سهل المشرع الجزائري عملية إثبات الملك الوقفي بكافة الطرق الشرعية والقانونية، بالإضافة إلى أنه منح له الشخصية المعنوية وفقا لأحكام الشريعة الإسلامية، وجعله يتمتع بالحماية الثلاثية، وهي عدم جواز التصرف فيه، وعدم قابليته للتقادم ولا للحجز عليه، كما ميّزه بحماية جزائية متمثلة في نصوص قانون الأوقاف التي أحالت مسألة الجزاء على قانون العقوبات، بحيث اتسمت بالصرامة من حيث التطبيق، وذلك عن طريق الحماية القضائية عبر مرفق القضاء، من خلال الدعاوى المرفوعة أمامه . *الكلمات المفتاحية: الوقف، العقار، آليات حماية الأوقاف، الأملاك العقارية، العقار الوقفي، حماية الملكية الوقفية، الملكية الوقفية، التشريع الجزائري. For an effective protection of el-Awkaf, The Algerian legislator has set up several of the legal mechanisms, that aims at protecting the real estate of el-Waqf properties, and this protection is represented in administrative structure, that ensure the protection of el-Waqf properties from attacks, The Algerian legislator also facilitates the process of establishing el-Waqf property by all legal methods, and making it a legal basis for its documentation, In addition to that it grants him the moral personality in accordance with the provisions of Islamic Sharia and makes him enjoy with the tripartite protection of el-Awkaf, which is the inability to dispose of it (Inalienable), and also his inability to prescribe, and as well as inability to seize it, and it also distinguishes him with a penal protection represented in the provisions of el-Awkaf Law that refers the issue of punishment to the penal code, as it is characterized by strictness in terms of application, And that is through judicial protection through the judiciary facility, through the cases filed before it.
