Abstract

Through what was presented above, it becomes clear to us that the right to candidacy is protected through control mechanisms, whether in its preparatory or subsequent stages, directly or indirectly. There is no doubt that the people's choice of their representatives who run for candidacy according to the different electoral systems, which guarantee the individuals in this society the true expression of their will, and it represents one of the basic components of what democracy should be. In this study, we discussed the most important guarantees that the Algerian legislator brought to protect the right to run for office. It can be noted that guaranteeing this right in the Algerian legislative system was not achieved until after the issuance of the 1989 constitution, which granted citizens the exercise of their right to run for candidacy on the basis of equality among them. To elect and run, and within the framework of this Constitution, Ordinance No. 7/97 was issued containing the Organic Law relating to the amended and supplemented electoral system, and then the Organic Law No. 12/01 relating to the electoral system, and accordingly a set of objective and formal conditions were stipulated in order for it to be a legal practice and in accordance with the principles of democracy. However, this is considered insufficient unless these practices are surrounded by oversight mechanisms to ensure its protection. In addition to the above, there is an oversight role for several effective bodies, the first of which is the Independent National Authority for Elections, which was established by Organic Law 19-07, to give it the powers to prepare, organize and supervise elections in a capacity, and the nomination process in particular, starting from receiving requests for candidacy and submitting individual forms to receiving the permit The nomination and adjudication of it, after studying it and examining its compliance with the legal requirements. The legislator has entrusted the Independent National Electoral Authority with all the powers related to the organization, supervision and management of elections in order to impart integrity and transparency to the electoral process.
