Abstract

تحم كٌ العدالة مرتبط بحسن اخت اٌر المضاة، ولهذا الأمر نظم المشرع الجزائري ك فٌ ةٌ لتكو نٌهم، وتع نٌٌهم، وترس مٌهم إذ أنشؤ المانون العضوي 11 00 المتضمن المانون الأساس للمضاء، وكذا المرسوم التنف ذٌي - 151 11 ل حٌدد واجبات المضاة وحمولهم، وكذا تنظ مٌ س رٌ مهنتهم وصولا إلى انضباطهم باتباع النظام - التؤد بٌ ،ً واتخاذ الإجراءات اللازمة الت حددها المشرع ف المانون الأساس للمضاء، مع مراعاة كل الضمانات الممنوحة للماض ،ً وهذا ما عٌزز استملال المضاة. نظم المانون وضع ةٌ المضاة ف إحدى الحالات إما الم اٌم بالخدمة، الإلحاق والاست دٌاع، كذلن طر مٌة إنهاء مهامهم بإحالتهم الى التماعد.Achieving justice is linked to the good choice of judges, and for this matter the Algerian legislature has organized a method for their formation, appointment, and their demarcation, as it established the Organic Law 04-11 that includes the Basic Law of the Judiciary, as well as Executive Decree 16-156 to define the duties and rights of judges, as well as regulating the course of their profession to reach their discipline by following the system Disciplinary measures, and taking the necessary measures specified by the legislator in the Basic Law of the Judiciary, taking into account all the guarantees granted to the judge, and this is what strengthens the independence of judges. The law regulates the position of judges in one case, either to serve, enroll and deposit, as well as how to terminate their duties by referring them to retirement.
