استصلاح الأراضي الفلاحية التابعة للأملاك الوطنية الخاصة عن طريق الامتياز

Abstract

يعتبر نظام استصلاح الأراضي عن طريق الامتياز من أهم الأنظمة لاستغلال الأ ا رضي الفلاحية التابعة للأملاك الوطنية الخاصة، وقد خ ّ صه المشرع بعدة نصوص قانونية أهمها المرسوم التنفيذي رقم 483-97حيث ُ عِرف هذا النظام في ظل هذا المرسوم بأنه تصرف تمنح الدولة بموجبه ولمدة معينة حق انتفاع بأراضي متوفرة تابعة لأملاكها الوطنية الخاصة لكل شخص طبيعي أو معنوي ويكون هذا الاستصلاح في الأراضي الصحراوية والجبلية والسهبية حيث يمكن أن يتحول هذا العقد إلى تنازل في الأخير. وقد نص على نظام الاستصلاح عن طريق الامتياز أيضا المنشور الوزاري رقم 1839الملِغي للمرسوم رقم 483-97حيث يختلف هذا النظام في أن الملكية تبقى للدولة على عكس المرسوم السابقhe system of land reclamation through concession is one of the most key systems for the exploitation of agricultural lands belonging to private national properties ،The legislator singled out it with several legal texts ،the most significant of which is Executive Decree No. 97-483 ،where this system was defined under this decree as an act whereby the state grants for a certain period the right to use available lands It belongs to its own national property for each natural or legal person ، and this reclamation is in the desert ، mountainous and flatlands ، where this contract can turn into a waiver in the end . The system of reclamation through concession was also stipulated in Ministerial Circular No. 1839 ،repealing Decree No. 97-483 ،as this system differs in that ownership remains for the state ،unlike the previous decree.
