الجزاءات الإدارية العامة في غير مجالي العقود و التأديب و مدى دستوريتها

Abstract

ملخص : قانون العقوبات الإداري هو قانون يستهدف تخفيف العبء عن الجهاز القضائي الجنائي، و تحويل عدد من الجرائم بشروط و ضوابط و ضمانات قانونية معينة من حيز قانون العقوبات إلى حيز قانون آخر، بحيث يتم العقاب على هذه الجرائم بعقوبات إدارية توقعها السلطة الإدارية، و يعتبر تفعيلا لنظرية الحد من العقاب، حيث تهدف إلى التحول عن الجزاءات الجنائية في جرائم معينة لصالح قانون آخر لعدم خطورة الجرائم، و استطاعة مواجهتها إداريا، بالإضافة إلى التخفيف على القضاء . و عليه يخرج من نطاق القانون الإداري الجنائي، الجزاءات التأديبية المفروضة على الموظفين العموميين التابعين لها، و الجزاءات التعاقدية على المتعاملين المتعاقدين معها. Abstract : Administrative Penal law is aimed at easing the burden on the criminal justice system; and to transfer a number of offences with certain conditions regulations and specific legal guarantees from the penal code into another law; so that offences are subject to punishment by administrative sanctions imposed by the administrative authority; and is considered to effectuate the theory of reduction of punishment, as it aims to shift away from criminal sanctions for certain offences in favour of another law; because of the less dangerous crimes and the ability to deal with them administratively; as well as to soften the burden on the part of the justice system. Accordingly; the disciplinary sanctions imposed on public officials; and the contractual sanctions against its contractors are outside the scope of the Administrative Penal law.
