Abstract
The present study aims at tackling the topic of human organs trade
which is considered among the recent topics that appeared as a direct result to
the development of technologies and the scientific medical tools applied in the
field of organs transplant and its deviation from the legal and the religious
restrictions which organize it .
It is one of the recent topics from the view of Islamic law insight it is
studied as part of calamity (nwazal ) where we can stand on the opinions of
Islam's scientists (foqaha )as concerning this issue and compare it with the
Algerian judicial law which stood firmly against human organs trade by passing
stringent laws and criminalization of these acts in accordance with the Islamic
laws which forbid trade in human organs because it represents a violation to
human dignity and a threat to society's safety and serenity.
This study is concluded with the important results that we
could reach in addition to the recommendations.
