Abstract

حظي قطاع السكف بإىتما خاص مف طرؼ الدولة وكفمو الدستور كحؽ لكؿ مواطف، بإعتباره أكثر القطاعات الاجتماعية حساسية، حيث نظ المشرع الج ا زئري مف خلبؿ العديد مف الم ا رسي والق ا ر ا رت صيغ عديدة تتلبئ مع فئات المجتمع، والتي مف بينيا صيغة البيع بالإيجار التي تعني الفئة المتوسطة. وجاءت د ا رستنا لتسميط الضوء عمى صيغة البيع بالإيجار لمسكنات المنجزة بأمواؿ عمومية، مف خلبؿ التعرؼ عمى الطبيعة القانونية ليذا النوع مف العقود، وذلؾ لتمكف الأف ا رد مف الحصوؿ عمى سكف يتماشى مع دخمي. وحرصا عمى بموغ الغاية مف البحث قمنا بطرح الموضوع في قالب منيجي، حيث تناولنا في الفصؿ الأوؿ المتضمف لمبحثيف، المفيو والشروط الموضوعية لعقد البيع بالإيجار أما الفصؿ الثاني فخصصناه للؤثار المترتبة عف عقد البيع بالإيجار والتي تض إلت ا زمات طرفي العقد والمنازعات الناشئة عف عقد البيع بالإيجار. وختمت الد ا رسة بخاتمة لأى النتائج.The housing sector has received special attention from the state and guaranteed by the constitution as a right for every citizen, considering it the most sensitive social sector, as the Algerian legislature, through many decrees and decisions, has organized many formulas that are compatible with the groups of society, among which is the formula for rent sale, which means the middle class. Our study came to shed light on the formula for rent sales for dwellings completed with public funds, by learning about the legal nature of this type of contract, so as to enable individuals to obtain housing in line with their income. In order to achieve the goal of the research, we presented the topic in a methodological format, as we dealt with in the first chapter, which includes two studies, the concept and the substantive conditions of the lease sale contract, while the second chapter we devoted it to the implications of the lease sale contract, which includes the obligations of the parties to the contract and the disputes arising from the lease sale contract. The study concluded with the most important results.
