العقارات غير مطالب بها بين التسوية الإدارية والقضائية

Abstract

من اجل حماية مصالح الأفراد قام المشرع الجزائري بالأخذ بنظام الشهر العيني وهذا من خلال عملية المسح العام للأراضي وقد أستحداث الأمر (75/74) المتضمن إعداد المسح العام وتأسيس السجل العقاري الذي كان له دور كبير في الاحصاء العام للوعاء العقاري بغية الخروج من الوضعية غير المستقرة في المعاملات العقارية وقد دعم هذا التوجه العديد من المراسيم والتعليمات ومن أهم نتائجه الترقيمات التي يتميز به كل عقار على حدى. غير ان عملية المسح قد اعتراها الكثير من الصعوبات كان لها الاثر السلبي في معرفة أصحاب العقارات وافرز العديد من النزاعات العقارية التي أرهقت أروقة المحاكم والتي دفع بالمشرع الجزائري إلى سن العديد من المراسيم والتعليمات محاولا معالجة هذه الإشكاليات وكان قانون المالية سنة2018 والتعليمة (4060) آخر هاته التعديلات وهذا من خلال نقل العقارات في حساب مجهولة الى حساب عقارات غير مطالب به أثناءIn order to protect the interests of individuals، the Algerian legislator introduced the month-in-kind system، and this is through the process of general land surveying، and this was introduced by the introduction of Order 75/74، which included the preparation of the general survey and the establishment of the real estate registry، which had a major role in the general census of the real estate container، and this was intended to get out of the precarious situation In real estate transactions، this trend has been supported by many decrees and instructions، and one of its most important results is the numbering that characterizes each property separately.
