Abstract

ملخّص: تهدف هذه الدراسة إلى الوقوف على موضوع نطاق تطبيق عقد المقاولة من الباطن في التشريع الجزائري، وعلى وجه الخصوص في قانون الصفقات العمومية، الذي نظم من خلاله المشرع نطاق ابرام عقد المقاولة من الباطن تحت تسمية المناولة، إذ نجده فرض عدة ضوابط وشروط يتعين على كل من المصلحة المتعاقدة والمقاول المتعاقد معها احترامها، والتي سنعرضها في هذه الورقة البحثية من خلال تحليل النصوص القانونية الناظمة لها، لمعرفة توجه المشرع الجزائري وموقفه بخصوص المقاولة من الباطن، للوصول إلى معرفة نطاق المقاولة من الباطن في الصفقات العمومية، لكي لا تتجاوز الأطراف المشاركة في ابرامها للحدود المقررة لهم، ومعرفة الشروط الواجب اتباعها، نظرا للأهمية البالغة التي تكتسيها المقاولة من الباطن بوصفها أداة تساعد على التنمية الاقتصادية والاجتماعية وتعمل على توفير شروطها وتسهل تحقيق أهدافها من جهة، وارتباطها بالمرفق العام من جهة أخرى. Abstract: The purpose of this study is to examine the scope of application of subcontracts in Algerian legislation, particularly in the law of public contracts, through which the legislator has regulated the scope of the conclusion of subcontracts under the name of "Subcontract." The legislator has imposed regulations and conditions that must be respected by both the contracting authority and the contractor, which we shall discuss in this paper through the analysis of the legal texts governing them. Through this analysis we seek to shed light on the Algerian legislator's orientation and position regarding subcontracting, in order to determine the scope of subcontracting in public contracts to ensure that the participating parties remain within approved limits and acknowledge the conditions to be followed. Subcontracting is an instrument of crucial importance to economic and social development, as it helps provide the conditions that facilitate the achievement of the objectives of this development and is characterized with strong linkage to the public utility.
