دور القاضي في حماية الأطفال الجانحين

Abstract

استخلصت هذه الدراسة دور قاضي الأحداث في التشريع الجزائري، حيث قدمنا من خلال هذا الموضوع إعطاء تعريفات على بعض المفاهيم الخاصة بالدراسة من عدة جوانب، كما تطرقنا إلى العوامل التي تقف خلف جنوح الأحداث بشئ من التفصيل وهذا بهدف لفت انتباه المختصين بوضع الحلول لظاهرة جنوح الأحداث التي هي في تزايد مستمر. كما تناولنا دور الضبطية القضائية نحو الإجراءات التي تقوم بها وهذا قبل محاكمتهم. أما الفصل الثاني فقد تناولنا فيه الجهة القضائية التي يتم من خلالها محاكمة الأحداث وما هي العناصر المشكلة منها، منوهين بشئ من التفصيل على التعريف بقاضي الأحداث وأهم اختصاصاته، والدور الذي يلعبه بداية من مرحلة التحقيق الأولي، ثم تنفيد الأحكام والقخعرارات، إضافة إلى المتابعة القضائية بعد تنفيذ العقوبة وكل هذه الإجراءات حسب ما نص عليه المشرع الجزائري الذي لم يدخر جهدا في الاهتمام بهذه الفئة ومدى التزام قاضي الأحداث بتنفيذ كل القوانين التي جاء بها المشرع الجزائري This study summarized the role of the juvenile judge in Algerian legislation. Through this topic, we presented definitions of some concepts related to the study from several aspects. We also touched on the factors behind juvenile delinquency in some detail, with the aim of drawing the attention of specialists in developing solutions to the phenomenon of juvenile delinquency. It is constantly increasing. We also discussed the role of the judicial police regarding the procedures it undertakes, before trying them. As for the second chapter, we discussed the judicial body through which juveniles are tried and what are the problematic elements of it, noting in some detail the definition of the juvenile judge and his most important powers, and the role he plays starting from the initial investigation stage, then implementing the rulings and rulings, in addition to the judicial follow-up after Implementation of the penalty and all these procedures are in accordance with what was stipulated by the Algerian legislator, which spared no effort in paying attention to this category and the extent of the juvenile judge’s commitment to implementing all the laws brought by the Algerian legislator.
