السلطة القضائية في ظل التعديل الدستوري لسنة 2020

Abstract

تعتبر التعديلات الدستورية لعام 2020 خطوة مهمة في سياق الإصلاحات الدستورية التي بدأتها السلطة الدستورية منذ تعديلات عام 1996. وتشمل هذه التعديلات إضافات هامة لضمان ودعم استقلالية السلطة القضائية، رغم وجود بعض العقبات التي تعيق استقلالية السلطة القضائية على المستوى الهيكلي والوظيفي، مثل عملية تعيين القضاة ورئاسة المجلس الأعلى للقضاء وتأثير رئيس الجمهورية على القضاء، بالإضافة إلى ممارسة حق العفو وتخفيض العقوبات واستبدالها.

The constitutional amendments for the year 2020 are considered an important step in the context of the constitutional reforms initiated by the constitutional authority since the amendments of 1996. These amendments include important additions to ensure and support the independence of the judiciary, despite the existence of some obstacles that hinder the independence of the judiciary at the structural and functional levels, such as the process of appointing judges and presiding over the Supreme Judicial Council and the impact of the President of the Republic on the judiciary, in addition to exercising the right of pardon and reducing and replacing penalties.
