التجارة الإلكترونية في التشريع الجزائري

Abstract

شهدت السنوات الأخيرة تطورا كبيرا في مجال الاتصال وتكنولوجيا المعلومات نتج عنها نوع جديد من التجارة عبر شبكة الإنترنيت وهي التجارة الإلكترونية، لذلك كان من الواجب على المشرع الجزائري إيجاد إطار قانوني ينظم التعاملات التي تتم من خلالها، ويعتبر القانون المدني من أول القوانين الذي تضمن في تعديله مصطلح إلكتروني، من خلال قبوله للسندات الإلكترونية في الإثبات إلى جانب القانون التجاري، ومنه ومن أجل مستقبل واعد للتجارة الإلكترونية في الجزائر كان لا بدّ من تطوير المنظومة القانونية بما يتوافق ومتطلبات العصر، كما تطرقت هذه الدراسة إلى النظام القانوني للعقد الإلكتروني في ظل القانون رقم: 18/05 المتعلق بالتجارة الإلكترونية الذي تضمن عدة أحكام لضمان وأمن التجارة الإلكترونية، تركت على وجه الخصوص على تكوين العقد الإلكتروني، متطلباته وشروطه، في إطار ممارسات التجارة الإلكترونية، كما تطرقت إلى أهم الآثار الناشئة عن إبرام هذا العقد. Recent years have witnessed a great development in the field of communication and information technology, which resulted in a new type of commerce via the Internet, which is electronic commerce. An electronic term, through its acceptance of electronic bonds in proof alongside the commercial law, and from it and for a promising future for electronic commerce in Algeria, it was necessary to develop the legal system in line with the requirements of the times. This study also touched on the legal system of the electronic contract under Law No.: 05/18 related to electronic commerce, which included several provisions for the guarantee and security of electronic commerce, left in particular on the formation of the electronic contract, its requirements and conditions, within the framework of electronic commerce practices, and it also touched on the most important effects arising from the conclusion of this contract.
