الأمن القضائي الأسري في تفعيل العدالة الأسرية

Abstract

لما كانت الأسرة هي نواة المجتمع، واستقرارها أساس استقراره، ولما كان استقرار الأسرة يتطلب الحفاظ على نظامها و توفير الحماية القضائية لها، خاصة إذا ما اضطر أفرادها اللجوء إلى القضاء، يصبح ضروريا تفعيل العدالة الأسرية بشكل ينصف المرأة ويصون كرامة الرجل ويحمي حقوق الأولاد. و يكون تفعيل العدالة الأسرية بتضمين نصوص قانون الأسرة في جانبيها الشكلي والموضوعي، (تعديلا، وإضافة)، قواعد تشمل حقوق كل فرد في الأسرة، وفي كل المراحل، قبل وأثناء رابطة الزواج، أو بعد انحلالها، وهذا ما سعى إليه المشرع الجزائري خلال التعديلات التي أحدثها في نصوص قانون الأسرة الجزائري بموجب الأمر رقم: 05-02 المؤرخ في 27 فبراير 2005.Since the family is the nucleus of societies, and its stability is the basis for its stability, and since the stability of the family requires preserving its system and preserving judicial protection to it, especially if its members are forced to resort to the judiciary, it becomes necessary to activate family justice in a manner or a way that is fair to women and preserves the dignity of men and protects the rights of children. The activation of family justice by including the provisions of the family law in both its formal and substantive aspects is (an amendment or addition) of rules that include the right of everyone in the family, and in all stages before and during the marriage union or after its dissolution, and this what the Algerian legislator sought through the amendments that he made in the texts of the Algerian family law in according to Ordinance No: 05-02 dated February 27, 2005.
