الحماية القانونية لبورصة القيم المنقولة في ظل التشريع الجزائري

Abstract

غداة الإصلاحات الاقتصادية أواخر الثمانينات ومطلع التسعينات، وتبني الدولة الجزائرية لنظام اقتصادي جديد، تمخضت عنها جملة من الافرازات منها ما جاء سنة 1993، بصدور المرسوم التشريعي رقم:93-10 والمتعلق بسوق بورصة القيم المنقولة، والذي تم بموجبه انشاء بورصة القيم المنقولة، والنص على جملة من المواد التي تشكل حماية لها، غير أنه لم يكن كافيا لحماية بورصة القيم المنقولة من الناحيتين المدنية ولا الجزائية، حيث تم تعديله بموجب الأمر رقم: 96-10 سنة 1996، وتلاه تعديل آخر بموجب القانون رقم:03-04 لسنة 2003، والذي جاء بالجديد وعزز من الحماية بنصه على جرائم لم يتم التطرق اليها في أحكام المرسوم التشريعي السالف ذكره. Economic information is the basis of a smooth financial market. Through this study, we tried to shed light on these legal protections of the stock exchange through the legislation that protect them .probably the most important is the COSOB, which is the shield and protector of the stock exchange
