دور الضبط الإداري و وسائله في محاربة المضاربة غير المشروعة

Abstract

من خلال د ا رستنا هذه نتعرض إلى دور الضبط الإداري و وسائله في محاربة المضاربة غير المشروعة ، إن النظر إلى الضبط الإداري على أنه في كفة و المضاربة غير المشروعة في كفة و التوجه إلى الأحكام الج ا زئية في محاربة مثل هذه الظواهر لايؤدي إلى إستق ا رر البلاد ، بإعتبار أن القانون 21 - 15 المؤرخ في 28 ديسمبر 2021 المتعلق بمكافحة المضاربة غير المشروعة ، جاء كقانون ردعي ضد المتعاملين الاقتصاديين و حماية السوق الوطنية من أشكال الندرة في السوق ، إلا أنه نجد أن الجانب الردعي ضد المخالفين أو بالأحرى ضد المجرمين الذين يقومون بالمساس بقوت و القدرة الش ا رئية للمواطن كما يقول المثل الشعبي " الموس وصل للعظم "، وجب على الضبط الإداري التصدي لمثل هذه التصرفات بإعتبار أن القانون 21 - 15 جاء بصفة عامة و مجردة . ومن خلال هذا المشروع البحثي حاولنا إب ا رز د ور الضبط الإداري في محاربة المضاربة غير المشروعة ، و كذا وسائله لتباين أهمية الضبط الإداري في محاربتها.Through this study we are exposed to the role of admistrative controle its means in the fight against illegale specultion if adminstrative control is considered to be on the side and illegale speculation crime on the side and the trend to penal provisions in the fight against such phenomena does not lead to the stability of the contry considering that law 21-15 of december 28 ,2021 on combating illegal speculation , It came as a deterrent law against economic operators and protecting the national mareket from types of scarcity in the mareket,However we find that the deterrent aspect is against violators or rather aganist criminals those who compromise the strength and purchasing power of citizen as the popular « saying goes the knife gt to the bone » . The administrative control shoul counteract such action considering that the law 21-15 cam in general and abstract. Through this research project we have tried to highlight the role of administrative control in the fight against illegal speculation ,As well as his means to demonstrate the importance of administrative control in fight it .
