Abstract

تعتبر الوكالة الإلكترونية واحدة من إنجازات الثورة المعلوماتية والتقدم التكنولوجي، حيث تقدم منظورًا جديدًا لمفهوم التعاقد، خصوصًا فيما يتعلق بقدرة التعبير عن النية من خلال وسيط إلكتروني يعرف بالوكيل الإلكتروني. هذا النظام الحاسوبي يقوم بإجراء المعاملات والعقود عبر الإنترنت مستخدمًا خصائصه الذاتية، متمتعًا بالمبادرة والاستقلالية والقدرة على التواصل. ومع ذلك، فإن التعاقد عبر هذا النظام يثير قضايا قانونية تتعلق بالاعتراف بشخصيته القانونية وبالتالي التصنيف القانوني لطبيعته، وشرعية العقود المبرمة من خلاله، ومدى مسؤوليته القانونية في حالة الإخلال بالتزاماته القانونية. The electronic agency is considered one of the achievements of the information revolution and technological advancement،providing a new perspective on the concept of contracting،particularly concerning the ability to express intent through an electronic intermediary known as the electronic agent. This is a computer system that carries out transactions and contracts over the Internet using its inherent characteristics،enjoying initiative،independence،and the ability to communicate. Nonetheless،contracting through this system raises legal issues regarding the recognition of its legal personality and subsequently the legal classification of its nature،the legitimacy of contracts concluded through it،and the extent of its legal liability in case of breach of its legal obligations.
