السلطة الوطنية لحماية المعطيات الشخصية في ظل القانون 18/07

Abstract

Through this study, we infer that the establishment of national authority and personal data came in line with the technological development witnessed by the state. Considering that this practice is specific and closely related to the individual, or what is known as personal data, it is therefore incumbent upon the Algerian legislator to protect this data from any attack. This authority takes a series of measures to process this data by its employees, playing two important roles in this field: a preventive role carried out before the attack occurs, and a deterrent role carried out after the attack occurs, aimed at stopping the attack and taking legal measures for it.نستنتج من خلال هذه الدراسة أن إنشاء السلطة الوطنية والمعطيات الشخصية جاء تماشيا مع التطور التكنولوجي الذي تشهده الدولة. وإذ ترى أن هذه الممارسة محددة ووثيقة الصلة بالفرد، أو ما يعرف بالمعطيات الشخصية، لذلك يتعين على المشرع الجزائري حماية هذه البيانات من أي هجوم. تتخذ هذه السلطة سلسلة من الإجراءات لمعالجة هذه البيانات من قبل موظفيها ، وتلعب دورين مهمين في هذا المجال: دور وقائي يتم تنفيذه قبل وقوع الهجوم ، ودور رادع يتم تنفيذه بعد وقوع الهجوم ، يهدف إلى وقف الهجوم واتخاذ الإجراءات القانونية له.
