الملحق كإجراء استثنائي في الصفقة العمومية في ظل التشريع الجزائري

Abstract

تعتبر الصفقات العمومية عقود مكتوبة تبرم مع متعاممين اقتصاديين لتمبية حاجيات المصمحة المتعاقدة وباعتبار أن الممحق وثيقة إدارية تابعة لمصفقة العمومية فمو شروط لإب ا رمو كما أن لو أنواع عديدة، ويخضع ىذا الأخير لآليات رقابة أثناء تنفيذه سواء رقابة قبمية عن طريق لجان الصفقات العمومية والوصاية والم ا رقب المالي أو رقابة بعدية عن طريق المحاسب العمومي والمفتشية العامة لممالية ومجمس المحاسبة. وحفاظا عمى حقوق كل طرف من الأط ا رف المتعاقدة فقد وضع المشرع آلية لتسوية منازعات ممحق الصفقة العمومية عن طريق التسوية الودية كمرحمة أولى بمجانيا المختمفة وكذلك التحكيم كمرحمة ثانية، وأيضا عن طريق التسوية القضائية التي يتم المجوء إلييا في حال فشل التسوية الودية وتكون عن طريق دعوى القضاء الكامل ودعوى قضاء الإلغاء وذلك من أجل ضمان حقوق المتعاقدين.Public deals are written contracts concluded with economic dealers to meet the needs of the contracting interest.
