السر المهني في القانون الجزائري

Abstract

بداية ظهر الاهتمام بالسر المهني كصورة من صور الواجب الأخلاقي، ومع مشاهدته المجتمعات والدول من تطور أصبح كتمان السر من اهم الواجبات والالت ا زمات الملقاة على عاتق المهني أو الموظف اتجاه صاحب هذا السر مما جعل منهم ملزمون بحفظه وعدم إفشائه، نظ ا ر لما تحمله هذه الأس ا رر من أهمية وما قد يسببه إفشائها من ضرر لصاحبه. وعليه قام المشرع الج ا زئري بتجريم هذا الإفشاء وفرض العقوبة على مرتكبه تحقيقا للمصلحة العامة للمجتمع من جهة وحماية لمصلحة الأف ا رد من جهة أخرى وللحفاظ عل طبيعة السر التي تتمثل في بقائه طي الكتمان، فأي إخلال بهذا الالت ا زم يرتب على المؤتمن عليه مجموعة من المسؤوليات سواء كانت ج ا زئية أو مدنية أو تأديبية. الا انه لكل قاعدة استثناء بحيث منح المشرع المؤتمن على السر إمكانية البوح به في حالات معينة دون ان يتعرض للعقاب أو المسائلة.Initially, the concern for professional secrecy appeared as a form of moral duty, and with the development witnessed by societies and countries, confidentiality became one of the most important duties and obligations incumbent on the professional or employee towards the owner of this secret, which made them obligated to preserve it and not disclose it, given what these secrets carry of the importance and the harm that its disclosure may cause to its owner. Accordingly, the Algerian legislator criminalized this creation and imposed the punishment on the perpetrator in order to achieve the public interest on the other hand and to preserve the nature of the secret that is to remain confidential. Any breach of this obligation entails a set of responsibilities, whether criminal or civil, or disciplinary. However there is an exception for every rule, whereby the legislator entrusted with the secret was granted the ability to reveal it in certain cases without being punished or questioned
