إف التطكر القانكني لكضعية الم أ رة في اطار الكثائؽ الدكلية كالاقميمية لحقكؽ الإنساف، ركز عمى كجو التحديد عمى تكضيح بعض المفاىي المتعمقة بحمايتيا كالتكقؼ عند بعض الحقكؽ المثيرة لمقمؽ كالتي لا ا زلت مكضع جداؿ كأخد كرد بيف المتحفظيف عمى اطلاؽ حرية الم أ رة كبيف المتحرريف مف كؿ القيكد التي تفرضيا العادات كالثقافات أك حتى الأدياف . إف بداية حماية الم أ رة كاف في مجالات محددة لا سيما مجاؿ العمؿ، فإف التكجو العا الذم فرضتو منظمة الأم المتحدة دفع بالاعت ا رؼ التدريجي بالمساكاة بيف الجنسيف في كؿ المجالات ليصبح الالت ا ز بالقضاء عمى التمييز كمف ث عمى العنؼ ضد الم أ رة مف بيف أكلكيات ىذه المنظمة كككلاتيا المتخصصة . إف عمؿ الم أ رة ليس ظاىرة إجتماعية جديدة ،فالم أ رة منذ أزؿ التاريخ كىي تعمؿ في الم ا زرع كالحقكؿ ، ىذا بالإضافة إلى مختمؼ التغي ا رت الإجتماعية كالإقتصادية كالثقافية التي مرت بيا معظ المجتمعات البشرية مكنت الم أ رة مف رفع مكانتيا في المشاركة الإقتصادية كلقد كاف لتعمميا الأثر الكبير في فسح فرص العمؿ أماميا فعممت في مختمؼ القطاعات الإقتصادية .
