أساليب البحث والتحري عن الجريمة الالكترونية

Abstract

عرف العالم سرعة كبيرة في تطور التكنولوجيا ساعد هذا التطور في ظهور جرائم جديدة سمية بالجرائم الالكترونية وكذلك عند ظهور هذه الجرائم ظهرت طائفة جديدة من المجرمين يطلق عليهم اسم المجرم الالكتروني ( الهاكر ) وهي جريمة عابرة للحدود لسرعة انتشارها وانخفاض كلفة هذه الجريمة وقلت الخطر على المجرم عند ارتكابها والربح السريع. ومن هذه الأسباب ظهور هذه الجريمة هو التوافق الفكري مع التطور التكنولوجي وأصبح مجتمع الرقمي حيث انتقل نشاط الأشخاص من الواقع الفعلي إلى الواقع الافتراضي وهذه الجريمة هيا حديثة ومن الصعب إثباتها بالوسائل والأساليب التقليدية مما جعل المشرع الجزائري ليتبنى أساليب خاصة حديثة في البحث والتحري في هذه الجرائم لكون طبيعتها خاصة

The world has witnessed a great speed in the development of technology. this development hes helped in the emergence of new crimes called electronic appeaed A new group of criminals appeared called the hacker information criminal a person who breaks into a computer system) It is a cross border crime due to its rapid spread the low cost of this crime the less danger to the person involved when committing it and the guickprofit one of the reasons for the emergence of this crime is the intellectual compatibility with technological development and it has become a digital society where people s activity has moved from actual reality to virtual reality. This crime is modern and it is difficult to prove it by traditional means and methods which led the Algerian legislator to build special and modern methods of research and investigation because its nature is special.
