Abstract

ملخص: يشكل القانون الدولي الإنساني أحد أهم فروع القانون الدولي العام، وهو يعنى بحماية ضحايا النزاعات المسلحة من جهة، وضوابط سير الأعمال العدائية من جهة ثانية. ولا يمكن أن نضمن احتراما لقواعد هذا القانون إلا بوجود ضمانات على المستوى الدولي، وأيضا على المستوى الداخلي. وتتمثل الضمانات الرئيسية على المستوى الداخلي في ضمانة الانضمام والالتزام بالاتفاقيات ذات العلاقة بهذا القانون، وضرورة المواءمة بين قواعد القانون الدولي الإنساني والمنظومة القانونية الداخلية للدول، وأخيرا، ضمانة القضاء الجنائي الوطني في قمع انتهاكات قواعد القانون الدولي الإنساني. وهذه الضمانة الأخيرة هي موضوع هذه الورقة البحثية، حيث يمثل القضاء الجنائي الوطني ضمانة أساسية في مجال إنفاذ قواعد القانون الدولي الإنساني على الصعيد الداخلي. الكلمات المفتاحية: قانون دولي إنساني – قانون جنائي - قضاء جنائي دولي – قضاء جنائي وطني. The role of the national criminal judiciary in suppressing violations of the rules of international humanitarian law Abstract: International humanitarian law is one of the most important branches of public international law, its scope concerns the protection of victims of armed conflicts on the one hand, and the controls on the conduct of hostilities on the other. It is not possible to ensure that the rules of this law are respected only with the existence of both international and internal guarantees. The main guarantees at the internal level are: accession to the relevant conventions, harmonizing the rules of international humanitarian law with the internal legal system of States, and finally, the guarantee of national criminal justice in suppressing violations of the rules of international humanitarian law. This last guarantee is the subject of this research paper, where national criminal justice is a fundamental guarantee in the field of enforcing the rules of international humanitarian law at the internal level.
