حماية الأسرة في ظل الشريعة الإسلامية والاتفاقيات الدولية

Abstract

عنوان الرسالة موسومٌ بـ: "حِمايةُ الأسْرة في ظلِّ الشَّريعة الإسْلامية والاتِّفاقيات الدَّولية"، وإشكاليتُهُ الرئيسةُ التي حاولَ الإجابةَ عنها تتمحورُ حولَ أوْجه الحماية التي أوْلتها الشريعة الإسلامية والاتّفاقيات الدّولية للأسرةِ، وما مدى توافق الشريعة الإسلامية والاتّفاقيات الدّولية بشأنِهَا، وتبدو أهمية الدراسة من خلالِ الأهدافِ التي تسعى إلى تحقيقهَا والمتمثلة في إبرازِ دور وعدالة الإسلام في الأحكامِ المتعلقة بالأسرةِ من خلالِ التدابير والوسائل الوقائية والعلاجية، وكذا دور الاتّفاقيات والمواثيق الدّولية والقانون والقضاء في بسطِ الحماية من خلالِ قراراتِهِ التي سايرت مستجدات الحياة. وقد جاءت الدراسة في مقدمة وفصل تمهيدي وثلاثة فصول؛ الفصل الأول: خصصتُه لحماية الأسرة من خلال إبرام عقد الزَّواج وآثاره في ظلِّ الشريعة الإسلامية والاتّفاقيات الدّولية، والفصل الثاني: جعلتُه لحمايةِ الأسرةِ من الجرائمِ المتعلقة بها في ظلِّ الشريعة الإسلامية والاتّفاقيات الدّولية، والفصل الثالث: وضعتُه للحمايةِ القضائية للأسرةِ حال الخلافات الزَّوجية في ظلِّ الشريعة الإسلامية والاتّفاقيات الدّولية، وخاتمة وفهارس فنيّة. ومن أهم النتائج التي وصل إليها البحثُ: اهتمّ الإسلام بالأسرةِ، وجعل لها الضوابط وحدد لها الأهداف الكفيلة بصيانتِهَا والمحافظة على بنائِهَا واستقامة كيانِهَا؛ وذلك بوضْعه نظامًا وقائيًّا وآخر علاجيًّا يكفل لها حل المشكلات والخلافات التي تطرأ عليها، وتهدد استقرارها أو استمرارها. كما عنيت الاتّفاقيات الدّولية بالأسرةِ؛ وذلك بتقنين نصوص تدعو لحمايتِهَا عمومًا، والمرأة خصوصًا، لا سيّما من خلالِ تجريم الأفعال الماسة بنظامِ الأسرةِ؛ كالإهمالِ العائلي والعنفِ الأسري. وأوصى البحثُ بوجوبِ الأخذ بأحكامِ الشريعة الإسلامية، بخصوصِ جرائم التخلِّي عن الالتزاماتِ الأسرية والعنف الأسري من قِبَل المشرع الجزائري؛ تحقيقًا لحمايةٍ أكمل وأشمل لها من كل انحراف وتفكك وتصدع، على أن يكون ذلك في تقنين جديد متخصص في الجرائمِ الأسريةِ، يسمى "قانون العقوبات الأسري"، كما دعا البحث الدّول الإسلامية إلى اتخاذِ موقف موحد إزاء الوثائق الدّولية المتعلقة بالأسرةِ والمرأةِ، والتمسك بالتحفظاتِ إزاء كل ما يتعارض مع أحكام الشريعة الإسلامية؛ صونًا للهوية الإسلامية والسيادة الوطنية، وطالب البحث الهيئات الدّولية باحترامِ إرادة الشعوب خاصة ما تعلَّق بالأحوالِ الشخصيةِ. The title of the thesis is: “Protection of the family under the Islamic law ‘Shariah’ and international conventions”. Its main problematic attempted to answer the question of the aspects of protection which have been attached great importance by Islamic law ‘Sharia’ and international agreements to the family and the extent to which the Islamic Shariah is compatible with the international conventions in this field. This study aims at highlighting the justice of Islam in the provisions related to family through preventive and curative measures, as well as the role of international agreements, covenants, law and the judiciary in extending protection through its updated decisions. The study contains an introduction, introductory chapter and three chapters. The first chapter is devoted to the protection of the family through the conclusion of marriage contract and its effects in Islamic law and international agreements. The second chapter deals with the protection of family from the related crimes in Islamic law and international agreements. The third chapter treats the judicial protection of family in case of marital disputes in Islamic law and international agreements, followed by a conclusion and technical indexes. The study concluded that Islam attaches importance to the family, and made its limits and set goals to maintain its construction and integrity, by setting a preventive and treatment system that ensures problem-solving. International agreements were also concerned with the family by codifying texts calling for their protection in general, and women in particular, especially by criminalizing acts that violate the family system, such as family neglect and domestic violence. The research recommended that the provisions of Islamic Sharia regarding the crimes of abandonment of family obligations and domestic violence by the Algerian legislator, should be adopted in order to achieve a fuller and more comprehensive protection from all deviation, through setting a new goal called "Family Penal Code". It also called the Islamic countries to take a unified stance towards international documents related to family and women, and adhere to reservations regarding everything that contradicts the provisions of Islamic Shariah, in order to preserve Islamic identity and national sovereignty. The study also asked the international bodies to respect the will of peoples, especially those relating to the conditions of the personal status.
