Abstract

قد عمل المشرع الجزائري على توضيح وإرساء المبادئ العامة للاستثمار، وهي حرية الاستثمار والمساواة والشفافية في الاستثمارات. وقد تحقق ذلك من خلال القانون رقم 22-18، تطبيقا للتعديل الدستوري ووفاء بالالتزامات الدولية. وأدخل المشرع الجزائري آليات جديدة لتحفيز الاستثمار، بما في ذلك المنصة الرقمية للمستثمرين كآلية لتشجيع الاستثمار، والمفوضية العليا المسؤولة عن النداءات المتعلقة بالاستثمار. اعتمد المشرع على ثلاثة أنظمة حوافز توفر للمستثمرين العديد من الحوافز والمزايا. وفيما يتعلق بالضمانات، حافظ المشرع على أحكام تشريعات الاستثمار السابقة وقدم مجموعة من الضمانات الجديدة، لا سيما في مجال. The Algerian legislator has worked to clarify and establish the general principles of investment, namely the freedom of investment, equality, and transparency in investments. This was achieved through Law No. 22-18, in application of the constitutional amendment and in fulfillment of international commitments. The Algerian legislator introduced new mechanisms to stimulate investment, including the digital platform for investors as a mechanism to encourage investment, and the High Commission responsible for appeals related to investment. The legislator relied on three incentive systems that provide investors with several incentives and advantages. Regarding guarantees, the legislator maintained the provisions of previous investment legislations and introduced a set of new guarantees, particularly in the area of intellectual property
