Abstract

تعزز النظام المؤسساتي الجزائري من خلال استحداث هيئة إدارية متخصصة أطلق عليها المشرع الجزائري إسم وسيط الجمهورية وذلك بموجب المرسوم الرئاسي 20-45 المؤرخ في15فبراير2020، والتي تعتبر هيئة قديمة متجددة حيث تأسست سنة 1996 وتم إلغاؤها 1999. تعتبر هيئة رقابية جديدة تمارس الرقابة الخارجية على أعمال الإدارة وحماية على الحريات وحقوق المواطن اتجاه سوء تسيير الإدارة سواء كانت مركزية أو لا مركزية. إن وسيط الجمهورية هيئة طعن غير قضائية هدفها حماية حقوق وحريات المواطنين والنظر في قانونية سير المرفق العمومي.وهي هيئة موضوعة لدى رئيس الجمهورية و تستمد سلطتها منه. حيث أنها زودت بالوسائل البشرية والمادية لإنجاز مهامها التي تعتبر ضيقة نظرا لوضع المشرع حدود قيدت بها. كما أنها معرضة لغياب الشفافية لعدم وجود الضمانات و الشروط التي تحقق لها الاستقلالية والحياد لممارسة مهامه على أكمل وجه وكما هو معمول به في الدول التي تأخذ بالنظام الامبودسمان.The Algerian system of establishments has been reinforced by new legislations in a form of a special administrative organisation. This project has been known as the medium of the republic, which was formed in 2020. This organisation is a considered as a new form of a previous one abolished in 1999. This is considered as a controller of exterior administrative work, and a defender of liberties and rights of any citizen against misorientations of administration whether it is central or not.This organisation is also a non-juridical one that seeks to regarding and observing local amenities. It has its own power from the president himself. It has been equipped with the means to achieve its targets in spite of the limitations decided by the legislator himself.It is also an object of lack of guarantees and conditions, and misusage, which makes the objectivity and independence of this organisation a mere dream far from the Ombudsman System.
