الوساطة الجزائية في التشريع الجزائري

Abstract

ملخص: أقر المشرع الجزائري الوساطة الجزائية تدعيما لبرنامج إصلاح العدالة و تعزيز دور النيابة العامة عن طريق آليات لتسيير الدعوى العمومية، كآلية بديلة للمتابعة في المخالفات و بعض الجنح البسيطة، التي لا تمس بالنظام العام و المحددة على سبيل الحصر، و ذلك في مواجهة القضايا و الدعاوى الجزائية المتزايدة في المحاكم و إيجاد أنظمة قانونية جديدة تكفل ضمان وضع حد للإخلال الناتج عن الجريمة أو جبر الضرر المترتب عليها و تأهيل و إصلاح الجاني اجتماعيا. Abstract: The Algerian legislator has approved penal mediation, in support of the justice reform program and the strengthening of the role of the Public Prosecution, through mechanisms for conducting public proceedings, as an alternative mechanism for follow-up on infractions and minor misdemeanors that do not affect the public order, in the face of increasing criminal cases and the creation of new legal systems ensuring that the breach resulting from the crime is brought to an end, or reparation for damage caused by crime and rehabilitation of the offender socially. Résumé en français : Le législateur algérien a approuvé la médiation pénale à l'appui du programme de réforme de la justice et du renforcement du rôle du ministère public à travers des mécanismes de régulation de l’action publique, comme mode alternatif de suivi des contraventions et de quelques délits, qui n’affectent pas l’ordre public, cela face à l'accumulation des actions pénales et la création de nouveaux systèmes juridiques pour mettre fin à la violation résultant de l’infraction ou réparer les dommages qu’ elle cause et la réhabilitation sociale du délinquant.
