القواعد والضوابط الفقهية الحاكمة لشركات المساهمة

Abstract

يعالج البحث موضوعا مهما في عالم الشركات اليوم، ألا وهو: "القواعد والضوابط الفقهية الحاكمة لشركات المساهمة"، وتكمن إشكاليته في توظيف القواعد والضوابط الفقهية لتنظيم عمل شركات المساهمة وفق أحكام الشريعة الإسلامية، وقد جاء الموضوع في مقدمة ومبحثين وخاتمة، فكانت المقدمة كنظرة شاملة للموضوع من حيث أهميته وتحديد إشكاليته والدراسات السابقة له، وخُصِّصَ المبحث الأوّل لدراسة مفاهيم رُكني البحث وهي: القواعد الفقهية وشركات المساهمة، أما المبحث الثاني ففيه سرد للقواعد والضوابط الفقهية مع شرحها وأدلتها وتطبيقاتها على شركات المساهمة، وجاءت الخاتمة بجملة من النتائج والتوصيات." This research deals with an important subject in the world of companies today namely:"" jurisprudence rules governing joint stock companies"". The problematic was in employing jurisprudence rules to regulate the work of joint stock companies in occordance with the provisions of islamic sharia; the stydy consists of introduction; two chapters and a conclusion. The introduction was a comprehensive view of the subject in terms of its importance, its problematic identification, and previous studies The first topic was devoted to studying the concepts of the two pillars of the research, which are: jurisprudence rules and joint stock companies. The second topic contains an account of the jurisprudential rules and controls with their explanation, evidence and applications to joint stock companies, and the conclusion came with a set of results and recommendations. "
