خصوصية أجهزة جمع الاستدلالات عن الجرائم المتعلقة بمعالجة المعطيات الشخصية

Abstract

تتميز الجرائم المتعلقة بمعالجة المعطيات ذات الطابع الشخصي بالكثير من الخصوصية الى حدما، فهذه الاخيرة تجعل من هذه الجرائم حديثة النشأة تنفرد بعدة خصائص تميزها عن غيرها و ذلك يعود اساسا الى الطبيعة القانونية الخاصة لهذه الأخيرة، رغم ان هذه الطبيعة الخاصة لا نجدها بدرجة كبيرة اذا تمت المعالجة بطريقة يدوية بقدر ما نجدها اذا تمت المعالجة بطريقة آلية، لذلك نجد ان المشرع الجزائري كغيره من التشريعات الأخرى افردها بإجراءات خاصة، هذه الاجراءات الخاصة تبدأ من مرحلة التحقيق التمهيدي فوفقا للقانون رقم 18/07، نجده قد اضاف جهاز جديد يقوم بالبحث والتحري وجمع الاستدلالات في هذه الجرائم ، وهذا الجهاز المستحدث هو السلطة الوطنية لحماية المعطيات الشخصية الى جانب الجهاز التقليدي الذي تعود له الولاية العامة بالبحث و التحري الا وهو الضبطية القضائية. Crimes related to the treatment of data personal nature are charactrized by a lot of privacy to some extent , as the latter makes these newly emerging crimes unique in many characteristics that distinguish them form others and this is mainly due to the special legal nature, Despite the fact that this special nature does not find it to great extent if it is handled as manual as we find it if is handled automatically. Therfore , we find that the Algerian legislator, like other legislations, has approved it with special procedures. These special procedures begin with the preliminary investigation stage, and they have agreed to law 18/07.In these crimes, this newly created body is the national authority for the protection of personal data, to the perpetrator of the traditional body to which public jurisdiction belongs to research and investigation , and that is the judicial seizure .
