الحماية القانونية لحقوق المؤلف في التشريع الجزائري

Abstract

يعتبر موضوع حقوق المؤلف من الموضاعات الجديدة نسبيا وذلك لإرتباطه بشكل كبير بالتطور التكنولوجي السريع و كثرة المؤلفات، فرغبة المؤلفين في الحفاظ على إبداعتهم من الضياع والسرقة دفعهم إلى البحث عن سبل للحفاظ على هذه الحقوق التي تعتبر في محلها وذلك لكون المجهود و التعب الذي بذل يجب أن يكلل بالتتوبج وصون الحقوق، فجاء التشريع في الأخير ليضع القواعد القانونية المؤطرة للحفاظ وصون حقوق المؤلف والجزائر كغيرها من الدول تبنت هذا النظام من خلال مجموعة من الأوامر آخرها الأمر 03-05 المتعلق بحقوق المؤلف والحقوق المجاورة.The subject of copyright is relatively new due to its strong connection to rapid technological advancements and the abundance of creative works. Authors' desire to protect their creations from loss and theft has driven them to search for ways to safeguard these rights, as the effort and hard work they put in should be rewarded and their rights preserved. Legislation has been enacted to establish legal frameworks for the protection and preservation of authors' rights. Algeria, like other countries, has adopted this system through a series of regulations, the latest being Order 03-05, which pertains to copyright and related rights.
