المجــــلس الأعــــــلى للقضــاء في ظل القانون العضوي 22/12

Abstract

The supreme judlicl council considers a constitutional consultativeinstituton ,view of the tasksentrusted to it as guarantor ofthe judges independence and the independence of the judiciary ,the current study sheds the light on the superior council of judiciary which is considered as a high constititonal judicial institution where by the judges refe to in order to defend and protect their interests. We have therefor tried through this study to highlight the comosition of the superior council of Magistray and its consecration of independence of the judge The mode the council is empowe red to conduct and organize the carees of the judges the edifice of judicial outhorty .Their composition and reconfiguration ,and these cases are mentioned in the 2020constititionl amendmrnt and in organic low no/22/12 the superme council of cassation its work and powers.It is this composition which guartantees the in case of error ,the question of the composition of the superior council of Magistracy raies many criticisms at the level of the countries of the word.يعتبر المجلس الأعلى للقضاء مؤسسة استشارية دستورية نظرا للمهام المنوطة به كضامن لاستقلال القضاة واستقلال السلطة القضائية، وتسلط الدراسة الحالية الضوء على المجلس الأعلى للقضاء الذي يعتبر مؤسسة قضائية دستورية عليا، حيث يقوم من خلاله ويلجأ القضاة إليها من أجل الدفاع عن مصالحهم وحمايتها. لذلك حاولنا من خلال هذه الدراسة إبراز تركيبة المجلس الأعلى للقضاء وتكريسه لاستقلالية القاضي والأسلوب الذي يخوله المجلس لتسيير وتنظيم شؤون القضاة صرح السلطة القضائية. إعادة التشكيل، وهذه الحالات مذكورة في تعديل دستور 2020 وفي القانون العضوي رقم/22/12 المجلس الأعلى للتمييز عمله وصلاحياته. وهذا التشكيل هو الذي يضمن في حالة الخطأ مسألة تكوين المجلس الأعلى. مجلس القضاء يثير انتقادات كثيرة على مستوى دول العالم
