مسائل الأقليات المسلمة في باب النكاح

Abstract

الملخص: موضوع رسالة الباحث موسوم بــ: "مسائل الأقليّات المسلمة في باب النكاح -دراسة فقهية مقارنة-"، وإشكاليته الرئيسة تتمحور حول مدى استيعاب الشريعة الإسلامية لمسائل الأقليّات المسلمة في باب النكاح، واستغراقها لما يستجدّ لها من نوازل. وقد جاء موضوع البحث في ثلاثة فصول: خصِّص أولُها كمدخل مفاهيمي يعين القارئ على تصوّر أهمّ المصطلحات التي لها صلة بموضوع الرسالة، وجعل ثانيها لدراسة مسائل منتخبة متعلِّقة بمقدّمات نكاح الأقليّات المسلمة وبيان حكمها الشرعيّ، وعُنِيَ ثالثها ببحث مسائل مؤثِّرة على عقود نكاح تلك الأقليّات، وبيان مدى توافقها مع مقاصد الشارع الحكيم، مع عقد مقارنة في جميع ما سبق -بقدر المستطاع- مع ما في القوانين والتشريعات الفرنسية المنظمة لعقود الزواج في فرنسا. ومن النتائج الأساسية التي وصل إليها البحث في هذا الموضوع، عدم جواز بعض الأنْكِحة المنتشرة لدى الأقليّات المسلمة في فرنسا؛ لتعارضها مع أحكام النكاح في الشريعة الإسلامية، ومخالفتها لمقاصده المبتغاة منه؛ إضافة إلى مصادمتها للقوانين والتشريعات الفرنسية المجرٍّمة لتلك الأنواع من الزيجات. وأوصى الباحث بضرورة عناية المجتهدين في نوازل الأقليّات المسلمة، بانتخاب أحكام شرعيّة تعين تلك الأقليّات على الصمود في وجه الغواية الإباحية الجنسية، وتفعيل مقاصد النكاح في واقعها انطلاقا من فهم دقيق لوضعيتها، ومراعاة لخصوصياتها المميّزة لها.

The summary of the subject of the researcher's thesis is tagged with: "issues of Muslim minorities in the marriage gate - A Comparative Jurisprudence Study", and its main problem revolves around the extent to which the Islamic Sharia comprehends the issues of Muslim minorities in the marriage gate, and its absorption of the new revelation. The subject matter of the research came in three chapters: the first of which was devoted as a conceptual introduction to help the reader visualize the most important terms related to the subject of the thesis , the second to study selected issues related to the introductions of marriage of Muslim minorities and the statement of their Sharia ruling, and the third concerned with the discussion of issues affecting the contracts of marriage of these minorities, and to indicate the extent of their compatibility with the purposes of the wise legislator, with a comparison in all of the above - as far as possible - with what is in the French laws and legislation regulating marriage contracts in France. One of the main results of the research on this topic is the inadmissibility of some of the widespread marriages among Muslim minorities in France, because they contradict the provisions of marriage in Islamic law, and contrary to its intended purposes, in addition to colliding with French laws and legislation criminalizing these types of marriages. The researcher recommended the need to take care of the hardworking in the dormitories of Muslim minorities, by electing Sharia provisions that help these minorities to withstand the temptation of sexual pornography, and activate the purposes of marriage in their reality based on a thorough understanding of their situation, and taking into account their distinctive characteristics.
