الممارسات التجارية غير النزيهة في القانون 04-02 المحدد للقواعد المطبقة على الممارسات التجارية

Abstract

إن المنافسة أمر مستجب بحيث أنها تدفع إلـــــــى التطور والتقدم في كل المجالات لكن بعد الإنفتاح الإقتصادي الذي شهدته الجزائر أدى إلـــــــى إشئدادها بين الأعوان الإقتصاديين وظهرت الكثير من المخالفات التي تمس بنزاهة الممارسات التجارية التي يتعدى فيها العون الإقتصادي على مصالح العون الإقتصادي الأخر المنافس أو على المستهلك ، ألأمر الذي إستدعـــى ضرورة تدخل المشرع بموجب أحكام القانون 04-02 المحدد للقواعد المطبقة على الممارسات التجارية ذلك لضبط السوق وقمع الممارسات التجارية غير النزيهة عن طريق آليات قانونية تتمثل في الجهات الإدارية و القضائية .Competition is a responsive matter, as it pushes for development and progress in all fields, but after the economic openness that Algeria witnessed, this led to its intensification among the economic agents, and many violations appeared that affect the integrity of commercial practices in which the economic aid transgresses the interests of the other competing economic agent or the consumer. This necessitated the need for the legislator to intervene in accordance with the provisions of Law 04-02 that specifies the rules applicable to commercial practices in order to control the market and suppress unfair commercial practices through legal mechanisms represented in the administrative and judicial authorities.
