تصخقشا مغ خلاؿ د ا رستشا ىحه إلى مػضػع الجعاوػ الاستعجالية في السادة العقارية التي رقع نطسيا السذخع الج ا دئخؼ إج ا خئيا بسػجب قانػف الإج ا خءات السجنية و الإدارية ،09-08 محاوليغ بحلظ إبخاز التعجيلات و الأمػر السدتحجثة التي أدخميا عمى ىحا الشػع مغ القزاء بإجخاءات وضعيا بسثابة الإشار العاـ لخفع الجعاوػ الاستعجالية أماـ القزاء العادؼ الخاضع أش ا خفيا لمقانػف الخاص، و كحلظ أبخزنا كيؽية تشطيسو أحكاـ بعس أىع أنػاع الجعاوػ العقارية الاستعجالية التي أوردىا في القانػف السحكػر عمى سبيل السثاؿ لا الحرخ نطخا لأىسيتيا و الأكثخ شيػعا بالشدبة لمخصخ الحؼ يجاىع الأشخاص في حقػقيع عمى العقار. إف السذخع الج ا دئخؼ عسج إلى ىحه الإصلاحات و الإج ا خءات تساشيا مع مقتزيات حدغ سيخ العجالة و نطخا للأىسية العسمية في حساية الستقاضيغ لحقػقيع العقارية و الستسثمة في الغاية السخجػة مغ المجػء إلى القزاء الاستعجالي بتجشب وقػع الزخر الشاجع عغ الخصخ السحتسل عغ شخيق اتخاذ تجابيخ تحفطية مؤقتة لحيغ الفرل في مػضػع الشداع أو عغ شخيق الفرل في الش ا دع بإج ا خءات سخيعة بشز القانػف Through our study، we touched on the subject of urgent lawsuits in the real estate article organized by the Algerian legislator procedurally under the Civil and Administrative Procedures Law No. 08-09، trying to highlight the amendments and novelties that it introduced to this type of judiciary with procedures established as the general framework for filing urgent lawsuits Before the ordinary judiciary whose parties are subject to the private law، and we also highlighted how it regulates the provisions of some of the most important types of urgent real estate lawsuits that it mentioned in the aforementioned law، as an example but not limited to، due to its importance and the most common in relation to the danger that invades people in their rights to real estate. The Algerian legislator has adopted these reforms and procedures in line with the requirements of the proper course of justice and in view of the practical importance of protecting litigants for their real estate rights، which is the desired goal of resorting to urgent justice by avoiding the harm caused by the potential danger by taking temporary precautionary measures until the decision is made. The subject matter of the dispute or by adjudicating the dispute with quick procedures according to the text of the law.
