المسؤولية القانونية عن إفشاء السر الميني في التشريع الج ا زئري

Abstract

تعد الأسرار المهنية من أهم المواضع المتشعبة لمالها من أهمية في تطوير عجلة التنمية، وقد تناولنا موضوع السر المهني لماله من أهمية في التشريع الجزائري، لأنه يقوم بالمساس بخصوصيات الافراد وسمعتهم ومركزهم الاجتماعي. وبما أن الإدارة العامة تهدف الى تحقيق النفع العام، حيث نجد ان القانون الجزائري منح الإدارة سلطة تقديرية في تأديب الموظف، وذلك من اجل حماية المرافق العمومية، وجعل الموظفين يقومون بواجباتهم نحو الوظيفة على أكمل وجه، وخاصة واجب الإلتزام بالسر المهني، ويكون توقيع العقوبة وسيلة لردع الموظفين مستقبلا في عدم ارتكابهم لنفس الأخطاء المرتكبة فالشخص المسؤول عن تصرفه وعن تصرفات الاخرين الموضوعين تحت تصرفه لكن تلك السيطرة لابد ان تكون في حدود القانون .Professional secrets are considered one of the most important issues for their importance in developing the wheel of development. We have dealt with the issue of professional secret because of its importance in Algerian legislation because it affects the privacy of individuals، their reputation and their social status. And since the public administration aims to achieve the public benefit، as we find that Algerian law grants the administration discretion in disciplining the employee، in order to protect public facilities، and make employees carry out their duties towards the job to the fullest، especially the obligation to adhere to professional secrecy، and the imposition of punishment is a means To deter employees in the future from not committing the same mistakes committed، the person is responsible for his behavior and the actions of others placed at his disposal، but that control must be within the limits of the law.
