Abstract

تتضمن هذه الورقة البحثية تقييما لسياسة المشرع الجزائري الجنائية إزاء جريمة الإجهاض، حيث تم من خلالها إيضاح وتقييم معالمها وتحديد عقوباتها ومدى توفيقه فيها بغية محاولة الحد منها، هذا من جهة، ومن جهة أخرى إيضاح وتقييم معالم الإجهاض غير المجرم الذي يأمر به الطبيب إنقاذا لحياة الأم عندما تتعرض للخطر بسبب الحمل. الملخص باللغة الأجنبية. The current research seeks to assess the Algerian legislator's criminal policy regarding abortion crime. It thoroughly clarifies and evaluates its feature, determines its sanctions, and the extent of its success to try to reduce it. On the other hand, it clarifies and evaluates the parameters of non-criminal abortion ordered by the doctor to save the mother’s life when she is exposed to danger due to pregnancy.
