أسباب إباحة جريمة التمييز في قانون العقوبات الجزائري

Abstract

جاء النصّ على جريمة التمييز في آخر تعديل لقانون العقوبات الجزائري سنة 2014، وقد نصّ المشرّع على هذه الجريمة في ثلاثة نصوص، الأوّل متعلّق بتحريم التمييز و العقاب عليه، والثاني إنصبّ على أنّ هذه الجريمة يمكن أن تكون محلاّ للمتابعة إذا ما ارتكبها شخص معنوي، أمّا نصّ المادة 295 مكرر 03 فقد خصّصه المشرّع الجنائي للأفعال التي تشكّل استثناءات على جريمة التمييز، أي أسباب الإباحة الخاصّة بهذه الجريمة، وقد خصّصنا هذا البحث لتحليل هذه المادّة الأخيرة، حيث حاولنا الإجابة على الإشكالية التالية: ما مدى الكفاية التّشريعية في أسباب الإباحة المتعلّقة بجريمة التمييز في قانون العقوبات الجزائري؟ وهذا من خلال بيان الأفعال المباحة في جريمة التمييز، ووقفنا على مختلف جوانب النّقص التي إعترتها. Abstract: Discrimination crime subject has been treated in the last amendment of the Algerian penal law in 2014, where the Algerian legislature has indicated this crime in three texts; the first related to the criminalist of discrimination crime and its punishments, the second indicated that this crime could be the object of the follow-up if it is done by a moral person. However, the article n° 295 bis 03 was devoted by the criminal legislature about the acts that constitute exceptions to this crime, means reasons of discrimination crime permissibility. In this context, we tried through this paper to analyse this last article for indicating the permissible acts in this crime and stood the negative aspects in this article.
