الضمانات القانونية لمنظمات المجتمع المدني في الوقاية من الفساد ومكافحته

Abstract

الشفافية التي يتوقعها من الحكومة وسعى و ا رء المصلحة العامة وبدورها ايضا التوعية من أجل الوقاية ومكافحة الفساد الإداري عن طريق التعبئة،وبالإضافة إلى قيمها على المشاركة في سن القوانين والتشريعات المتعلقة بالفساد الإداري وذلك بتعزيز علاقة مؤسسات المجتمع المدني مع السلطات التشريعية والتنفيذية في الدولة والمتابعة القضائية لحالات الفساد فكان للجمعيات الج ا زئرية دور كبير في التوعية الإجتماعية بمخاطر الفساد وانعكاساته على المجتمع،بالإضافة إلى إعداد د ا رسات وبحوث من اجل معرفة مخاطر هذه الظاهرة والكشف عن المفسدين ومحاولة تقديمهم للقضاء. إن دور ومساهات المجتمع المدني في مكافحة الفساد الإداري بالج ا زئر لا ي ا زل ضعيف إذا ما قورين بأدواره في الدول العربية الأخرى فالإشكال لا ي ا زل مطروحا حول إستقلالية المجتمع المدني الج ا زئري ومصادر تمويله.This study aims to find out the relationship between civil society organizations and the administrative coruption phenomenon through the role that's played by this organizations and her combating it. Through this studay, we tried to demystify and answer the quetions and problem that is set reprsented in what is the civil society and the extent of it's role in combating administrative corruption in algeria. Therefore, the study focus on tow main things, the frist is a study on the nature of civil society organizations and identifying their characteristics, types, function, and role. Secondly, it is represented in a study on the phenomenon of corruption, and its diagnosis, by identifying it's nature, types, manifestions and causes, and the role played by organizations in combating administrative corruption, and showing the relationship between . The rapid and large spread of this phenomenon and the inability of institutions to combat and prevent corruption through the legal and regulatory systhem and practied reality of it is for this reason a set of mechanisons that cam support the preformance of these organisations have been presented . Civil society is also known in the last decades that it is new in Algeria in general and does not have sufficient experience in combating it in addition to its problems and conflict within the administrative system, and the lack of qualification and resources of its members, but the democratic openness of civil society gave it the determination and will to play its role to the fullest with regard to administrative corruption . In our latest study of the legal guarantees of civil society organizations, we resorted to preventive mechanisms represented in the contribution of decision-making by pressure on decision makers and take it for legislation that concerns the reality of the citizen and is in sensitization and monitoring through the media, awareness and guidance and the development of anti-corruption values ,and we also resorted to In addition to its values of participation in the enactment of lawsand legislation related to administrative corruption by strengthening the relationship of civil society institutions with the legislative and executive authorities in the state and judicial follow-up of cases of corruption, Algerian associations have played a major role in raising social awareness of the dangers of corruption and its repercussions on society, in addition to preparing studies and research in order to know the dangers of this phenomenon and detect spoilers and try to bring them to justice . The role and contribution of civil society in the fight against administrative corruption in Algeria is still weak if compared with its roles in other Arab countries, there are still questions about the independence of Algerian civil society and its sources of funding
