Abstract

تناولت هذه الدراسة موضوعا هاما من موضوعات القانون الإداري، وهي إجراءات تفويض المرفق العام، من خلال بيان أصل وجوده والتعرف على مفهومه، والإطار القانوني الذي ينظمه، فجاءت الدراسة في فصلين حيث جاء الحديث في الفصل الأول عن الإطار المفاهيمي لإجراءات تفويض المرفق العام حيث تناولنا في المبحث الأول مفهوم تفويض المرفق العام وذلك من خلال تقسيمه إلى مطلبين حيث تم التطرق في المطلب الأول حول نشأة فكرة تفويض المرفق العام و وتم التطرق في المطلب الثاني إلى تعريف تفويض المرفق العام ، بينما في المبحث الثاني تطرقنا إلى تمييز تفويض المرفق العام عن المفاهيم المشابهة له في المطلب الأول، وفي المطلب الثاني تحدثنا عن أنواع تفويض المرفق العام، وجاء الحديث في الفصل الثاني عن الإطار القانوني لإجراءات تفويض المرفق العام حيث تناولنا في المبحث الأول شروط وصيغ إجراءات تفويض المرفق العام وتطرقنا في المبحث الثاني إلى مرحلة تأهيل المترشحين المقبولين للتفاوض ومرحلة التفاوض ومنح التفويض.This study dealt with an important topic of administrative law, which Is the procedures for delegating the public facility, by explaining the origin of its existence and identifying its concept, and the legal framework that regulates it. The first topic is the concept of delegating the public utility, by dividing it into two requirementsWhere the first requirement dealt with the emergence of the Idea of delegation of the public facility and the second requirement was addressed to the definition of the delegation of the public facility, while in the second topic we touched on distinguishing the delegation of the public facility from similar concepts in the first requirement, and in the second requirement we talked about the types of facility delegation The general discussion came In the second chapter about the legal framework for the procedures for delegating the public facility. In the first chapter, we dealt with the conditions and formulas of procedures for mandating the public utility. In the second chapter, we touched on the stage of qualifying the candidates accepted for negotiation and the stage of negotiation and granting the mandate.
