صفة الجار في غير مالك العقار

Abstract

يتحدد نطاق الجوار من حيث الأشخاص بتحديد من يصح أن يطلق عليه وصف الجار. سواء تعلق الأمر بالمتضرر أو بمحدث الضرر أو كل من كانت له مصلحة بموجب علاقة تقارب مكاني وتجاور بين العقارات نتج عنها ضرر معين. وما أثار الجدل بين الفقهاء والقضاة هو مدى وجوب اقتصار هذه الصفة ــــ أي صفة الجار ــــ على المالك أو إمكانية امتدادها إلى غيره ممن لا يتمتعون بحق الملكية كالمستأجر والمقاول والحائز. This led to the dispute among the jurists and judges about to what extent this attribute -neighborhood- should be restricted to the landlord or extending it to people who don't have the right of ownership like the lessee, the contractor, and the holder.
