علاقة الولاية بالمقاطعات المنتدبة في التنظيم الإداري الجزائري

Abstract

.The administrative division in Algeria went through several successive stages of the existence of political reforms until the legislator introduced a presidential decree 15/140 aimed at establishing administrative provinces within some states and defining the special rules applicable to their organization and functioning as well as the tasks of the delegated governor. To be completed by Presidential Decree 18/303 and Presidential Decree 18/337, the organization and functioning of these administrative districts is subject to Executive Decree 15/141. The establishment of administrative districts within some states must create a legal relationship between the administrative districts and the mother state, as it is subordinate to them, so this relationship is represented in the relationship The organizational structure is due to the presence of geographical, sovereign, economic, and cultural reasons, and a functional relationship that is represented in the tasks and powers of the delegated governor who is considered a subordinate body to the governor so he returns to him in every small and large and can receive an authorization in that, and the administrative district council that implements the decisions of the state council, the sections The administrative authorities seek to improve and upgrade the public service in response to the growing interests and needs of citizens, but it has raised a doctrinal, legal and political debate in determining the extent of its constitutionality, legality, nature, powers, functions, position and financial obstacles that hinder it. مر التقسيم الإداري في الجزائر بعدة مراحل متعاقبة لوجود إصلاحيات سياسية وإدارية إلى أن إستحدث المشرع مرسوم رئاسي 15/140يهدف إلى إنشاء مقاطعات إدارية داخل بعض الولايات وتحديد القواعد الخاصة المطبقة على تنظيمها وسيرها وكذا مهام الوالي المنتدب. ليكمله المرسوم الرئاسي 18/303 والمرسوم الرئاسي 18/337،وتنظيم وسير هذه المقاطعات الإدارية يخضع للمرسوم التنفيذي 15/141،فإنشاء مقاطعات إدارية داخل بعض الولايات لابد أن يخلق علاقة قانونية بين المقاطعات الإدارية والولاية الأم فهي تابعة لها تبعية مطلقة وجزء منها، فتمثلت هذه العلاقة في العلاقة التنظيمية وذلك لوجود أسباب جغرافية وسيادية وإقتصادية وثقافية، وعلاقة وظيفية تمثلت في مهام وصلاحيات الوالي المنتدب الذي يعتبر هيئة تابعة للوالي فيرجع له في كل صغيرة وكبيرة ويمكنه أن يتلقى تفويضا في ذلك، ومجلس المقاطعة الإدارية الذي يقوم بتنفيذ قرارات مجلس الولاية، فالمقاطعات الإدارية تسعى لتحسين وترقية الخدمة العمومية بالإستجابة لمصالح وحاجيات المواطنين المتزايدة، إلا أنه أثير جدلا فقهيا وقانونيا وسياسيا في تحديد مدى دستوريتها وقانونيتها وطبيعتها وصلاحياتها ومهامها ومكانتها والمعوقات المالية التي تعترضها.
