صلاحيات رئيس المجلس الشعبي البلدي في مجال العمران

Abstract

جاء الفانون 90/29 المتعلق بالتهيئة والتعمير الذي وضعه المشرع الجزائري لكي ينظم مجال العمران، الذي أعطى فيه لرئيس المجلس الشعبي البلدي صلاحيات عديدة في هذا المجال ، بحيث تتمثل هذه الصلاحيات في القرارات القبلية التي اعتمدنا فيها عن المخطط التوجيهي التي تحدد الإطار العام للتهيئة والتعمير وتنظيم ومراقبة التوسيع العمراني ، أما مخطط شغل الأراضي يتضمن مبادئ وأساليب تقنية للتط تقوم اللامركزية الإدارية كأسلوب في التنظيم الإداري على أساس الحد من حجم المهام التي تضطلع بها الحكومة المركزية وتوزيع الصلاحيات بينها وبين جهات مصلحية أو إقليمية يعترف لها بالشخصية المعنوية. واللامركزية صورتين مرفقية تقوم على أساس الاعتراف لمرفق معين بالشخصية القانونية وتنظيم مستقل عن الجهة المركزية، وأخرى إقليمية تبنى على أساس الاعتراف بوجود وحدات إقليمية تتمتع بالاستقلالية بكيانها، والجزائر على غرار باقي الدول تبنت العمل بهذا النظام، فمنذ الاستقلال سعت السلطات الجزائرية إلى تأسيس تنظيمات لامركزية، وذلك من خلال تبني كل الدساتير الجزائرية لمبدأ اللامركزية، وتجسد ذلك في الصلاحيات الواسعة التي أوكلت للجماعات المحلية عبر الإصلاحات المستمرة، وذلك في كافة المجالات، حيث اعتمد المشرع الجزائري على التقسيم الثنائي المتمثل في الولاية والبلدية، وتعتبر هذه الأخيرة هي الجماعة الإقليمية القاعدية للدولة فهي تتمتع بالشخصية المعنوية والذمة المالية المستقلة، وتم تقسيم هيئاتها وهياكلها إلى ثلاثة أصناف وهم المجلس الشعبي البلدي، والأمين العام، ورئيس المجلس الشعبي البلدي، وهذا الأخير الذي خول له القانون مجموعة من الصلاحيات في العديد من المجالات، كتمثيله لكل من أعمال الحياة المدنية والإدارية، ويرأس المجلس الشعبي البلدي وينفذ ميزانية البلدية...، ونخص بالذكر صلاحياته في مجال العمران، مما يجعله يظهر كفاعل رئيسي في مجال العمران، والذي يعتبر من أهم أدواته المخطط التوجيهي ومخطط شغل الأراضي الذي يقوم بإعداده رئيس المجلس الشعبي البلدي، وكما أنه ملزم باتخاذ التدابير الوقائية لأجل الحفاظ على سلامة وأمن الأشخاص وأن يأمر بهدم الجدران أو المباني، كما له أن يرخص بذلك في الظروف العادية.The Minister of Planning and Construction, appointed by the Algerian legislator to regulate the area of urbanization, gave the President of the Municipal People's Assembly several powers in this field.
