التعويض عن الضرر الجمالي الناتج عن حوادث المرور في القانون الجزائري

Abstract

يعتبر الضرر الجمالي الناتج عن حوادث المرور من بين الأضرار التي نص عليها المشرع الجزائري على سبيل الحصر في جدول التعويضات الخاص بضحايا الحوادث الجسمانية في النصوص القانونية السارية المفعول، وقد ساوى المشرع الجزائري بين العجز الناتج عن حادث مرور والعجز الناتج عن حوادث العمل والامراض المهنية وطبق عليهما قانون واحد. هذا وأعطى القانون الجزائري للمضرور جماليا تعويضا حسب ما يحدده الخبير الطبي في خبرته من مبالغ جاعلا التقرير الطبي كمعيار لتحديد قيمة التعويض عن الضرر الجمالي بغض النظر عن الظروف الخاصة بالمضرور كالسن والجنس والمهنة وغيرها من الظروف الاجتماعية. الكلمات الافتتاحية: حادث مرور؛ جسماني؛ تشويه؛ الضرر الجمالي؛ التعويض؛ خبرة. Abstract: The esthetical mutilation resulting from traffic accidents is one of the damages stipulated by the Algerian law, exclusively, in the panel of indemnities concerning the physical accidents’ victims in the legal texts in force, so the Algerian law marker made the disability resulting from traffic accidents, the disability resulting from work accident and the professional diseases equal and then he applied a single law. Moreover, the Algerian law gave the aesthetically mutilated an indemnity according to what the medical expert defined as a an indemnity amount, making the medical report as a measure to define the indemnity value for the esthetical mutilation, regardless the mutilated particular situations, like the age, sex, profession and other social situation
